Q-Seal LLC warrants that natural stone tiles applied with Q-Seal by an authorized Q-Seal distributor will not require resealing for as long as you own the home in which the tiles are installed. This warranty is limited to interior, residential installations, and is for the benefit of the original purchaser of such tiles only. Any outdoor or commercial use voids this warranty.

 

IMPORTANT: ALL TILES MUST BE INSPECTED PRIOR TO INSTALLATION FOR VISUAL DEFECTS OR NON-CONFORMITIES IN THE Q-SEAL PROTECTIVE SEALER. INSTALLATION OF TILES THAT HAVE APPARENT VISUAL DEFECTS OR NON CONFORMITIES IN THE Q-SEAL PROTECTIVE SEALER VOIDS THE Q-SEAL FOREVER LIMITED WARRANTY.

Exclusive Remedy

• The warranty holder must at all times reasonably assist Q-Seal LLC by providing access to the premises for inspection and follow all instructions for removal of stains.
• A warranty claim can be valid ONLY if the Q-Seal applied to a natural stone tile is proven to fail in its essential purpose of not requiring resealing.
• The sole and exclusive remedy for a breach of this limited warranty is that Q-Seal LLC will, at its sole discretion, repair or replace the specific tile(s) that has failed Q-Seal.
  • In the event of repair, Q-Seal LLC will remove Q-Seal from the surface of the specific tile(s) that have failed Q-Seal on it, reseal the surface with a stone sealer, and refund the purchase price of the Q-Seal potion of the purchase price for the affected tile(s).
• In the event of replacement, Q-Seal LLC will remove and replace the specific tile that has failed Q-Seal on it with the same or comparable product (exact color match is not guaranteed, as stone is a natural product). Q-Seal LLC will not pay more for the replacement material and installation labor, calculated on a square foot basis, than the original cost of the replaced material and labor to install such material.

Q-Seal LLC will not pay any additional costs incurred, including plumbing, electrical, gas, paint or trim costs, as well as any incidental repairs or modifications.

In the event that the sole and exclusive remedy described above fails in its essential purpose, the liability of Q-Seal LLC is limited to the dollar value, on a square foot basis, of the original purchase price of the materials being replaced and the original labor cost of installation.

 

Limitations

Q-Seal protected stone makes the stone resistant to stains and chemicals, but not impervious to these agents. The presence of a stain, chemical etching, mold or any other damage is not a valid claim under this warranty. Carefully read the applicable Installation, Use and Care Instructions for more information. Please take note of these other important limitations to this warranty.

• Proper Installation and Care: This warranty only applies to stone tile installed in accordance with generally accepted methods for the installation of stone tile as set forth in the Tile Council of North America Handbook for Ceramic, Glass and Stone Tile Installation, and installed and maintained in the manner specified in the applicable Q-Seal Natural Stone Installation, Use and Care Instructions.
• Interior Installations Only: The warranty is limited to interior installations of natural stone and does not cover uses of Q‑Seal exposed to outside weather and climate conditions
• Residential Installations Only: The warranty is limited to residential installations, and does not cover use of products for "commercial" uses.
• Non-Transferable: This warranty is non-transferable and is for the benefit of the original purchaser of the stone tile only (or the original resident, if the home is purchased new from a non-resident builder/owner). The warranty is void if the tiles are moved from the original place of installation.
• Chip, Flake and Scratch Limitation: The warranty does not apply to areas where the stone tile becomes damaged due to chipping, flaking or scratching. In the event the tile becomes damaged, Q-Seal may not be present in the damaged area. You may be able to protect that area with conventional stone sealer.
• Abnormal Use and Conditions: This warranty does not cover abnormal use or conditions, or abuse in any way. "Abnormal use or conditions" includes, but is not limited to, damage from mishandling or misuse, damage from excessive heat or fire, physical or chemical abuse, vandalism, and damage from improper care and maintenance.

How to Make a Claim

To make a claim under this limited warranty, Q-Seal LLC must receive written notification of the alleged defect within thirty (30) days of discovery. Send claims and the documentation detailed below to: Q-Seal LLC, 92 Park Street, Rutland, VT 05701, Attention: Q-Seal Customer Service.

As a condition of this limited warranty, you must provide proof of purchase for materials and installation labor. Proof of purchase for materials is a valid receipt from the store and must show purchase date, name and address of store purchased from, name and item number of stone tile purchased, quantity of Q-Seal Natural Stone purchased and price paid for each purchase. Proof of purchase for installation labor is a valid receipt from the installation contractor and must show installation date, name and address of the installer, quantity of the stone tile installed, and price paid for installation of the stone tile.
Proof of payment in full is also required.

Extent of This Warranty

THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY, EXPRESS OR IMPLIED, GIVEN WITH RESPECT TO Q-SEAL. IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY EXCLUDED. SOME STATES DO NOT ALLOW EXCLUSIONS OR DISCLAIMERS OF IMPLIED WARRANTIES OR OTHER RESTRICTIONS ON IMPLIED WARRANTIES (SUCH AS LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS), SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

Q-SEAL LLC IS NOT RESPONSIBLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
